International Relations expert, Dr Vladmir Antwi-Danso, has said the extradition of embattled CEO of Menzgold from Dubai should not be difficult as some have suggested.<\/p>\n\n\n\n

His\n assertion comes on the back of concerns that the extradition process \nfor Nana Appiah Mensah, known popularly as NAM 1, could prove daunting \ndue to the absence of an extradition treaty between Ghana and the Gulf \ncountry.<\/p>\n\n\n\n

However, Dr Danso told Class FM on Tuesday that \u201cin most instances, countries sign bilateral agreements if they have not accented\n to an international multilateral agreement. Extradition is mostly \nbilateral and if Ghana and the Emirates have such a bilateral \nrelationship, then it is not difficult at all for extradition…\u201d<\/p>\n\n\n\n

\u201cIn\n this case, the organisations must talk to each other and I think \ninstitutions are already in Dubai making things ready for him to get \nextradited\u201d, Dr Antwi-Danso said, adding: \u201cOur security agencies are \nalso involved very seriously, and it means we\u2019ve had some kind of links \nwith the security agencies of the Emirates and, therefore, it’s not \ngoing to be any fight at all; he is going to come home.\u201d<\/p>\n\n\n\n

Opposing view<\/strong><\/p>\n\n\n\n

This view runs counter to that of a law lecturer at the Ghana Institute of Management and Public Administration (GIMPA) has said.<\/p>\n\n\n\n

Justice Srem Sai told Joy News on Tuesday that the delegation sent to\n Dubai by the government to request the extradition of NAM1 will be \nbased purely on diplomacy rather than law.<\/p>\n\n\n\n

He explained to Joy News that this is because Ghana does not have an extradition treaty with the UAE.<\/p>\n\n\n\n

\u201cThe Deputy Attorney General [Joseph Dindiok Kpemka] would have a lot\n of work to do in terms of diplomacy because the requested person, as we\n understand in the case, is already facing some criminal charges in the \nUAE.<\/p>\n\n\n\n

\u201cThe period of time and has been detained as we have it, we don\u2019t \nknow whether it has been a series of detention and release or it \nis one-off detention. But the fact that from December 7, until now he is\n still working out his bail conditions also means it is a serious \nmatter.<\/p>\n\n\n\n

He said that is where the challenge will be for Mr Dindiok Kpemka.<\/p>\n\n\n\n

A high-powered government delegation is in Dubai to press for the extradition of embattled Menzgold CEO.<\/p>\n\n\n\n

The delegation includes Deputy Attorney General, Joseph Dindiok \nKpemka, a representative from the Economic Organised Crime Office \n(EOCO), the Bureau of National Investigation (BNI) and National \nSecurity.<\/p>\n\n\n\n

An Accra Circuit Court issued a warrant for his arrest last week but a\n press release by the police on Monday indicates that NAM1 has already \nbeen arrested in the United Arab Emirates (UAE) capital on December 7 \nafter \u201ca gold deal gone wrong.\u201d<\/p>\n\n\n\n

The police in the statement also said they have been to Dubai to see \nthe fugitive in custody but failed to tell if it was prior to the arrest\n being issued on January 13 or after.<\/p>\n\n\n\n

The Deputy Attorney General in an interview on Top Story on Joy FM \nsaid government is bent on bringing NAM1 to face the law and will not \nrest until that happens.<\/p>\n\n\n\n

He said the delegation\u2019s mission will be to \u201ctry to strike a deal \nwith the government of the Emirates to see to the fact that he is \nbrought back to Ghana to face justice.\u201d<\/p>\n\n\n\n

But law lecturer Srem Sai said it is an \u201calmost impossible\u201d task to extradite him to Ghana. <\/p>\n\n\n\n

He said this is because UAE law does not allow a person to leave the \njurisdiction when he\/she is facing criminal charges within the country.<\/p>\n\n\n\n

\u201cThat I don\u2019t think will be negotiable and if you look at the offence he is going to be charged with, he is likely to face between 10 to 25 years in jail. I don\u2019t think the UAE authorities\u00a0are going to allow him to be extradited to Ghana if he is found guilty,\u201d he said.\u00a0<\/p>\n\n\n\n
