The Minister of Information, Mr Kojo Oppong Nkrumah, has described those questioning the legality of the Presidential Commission of Inquiry<\/a> set up to investigate the violence that characterised the Ayawaso West Wuogon by-election<\/a> as people\u00a0grossly misinformed of the law.<\/p>\n\n\n\n

He said the commission of inquiry was not a constitutional instrument that required it to be laid before Parliament for 21 days prior to its establishment but rather was an executive instrument that did not require laying it before Parliament for 21 days.<\/p>\n\n\n\n

\u201cSo the proponents of the argument that the instrument for setting up\n of the commission should have been laid before Parliament for 21 days \nare grossly misinformed on the law and grossly misinformed on the facts \nbecause the law did not support that view,\u201d he stated.<\/p>\n\n\n\n

Executive instrument<\/strong><\/p>\n\n\n\n

Addressing the press at the just-ended national security stakeholders\u2019 dialogue at Peduase near Accra, Mr Nkrumah said \u201cThe executive instrument for the Commission of Enquiry was dated February 6, 2019, and issued by the command of President under the signature of the Vice President, Dr Mahamudu Bawumia.<\/p>\n\n\n\n

\u201cPerhaps those who are making that argument are not privy to that \nfact and we need to help them to be privy to that fact so that they do \nnot misinform the public,\u201d he stated.<\/p>\n\n\n\n

The two-day dialogue created a platform for security experts to \ndeliberate on emerging security threats in the country such as political\n vigilantism, armed robbery, kidnapping, murder and terrorism.<\/p>\n\n\n\n

The participants included heads of security agencies, officials of \nthe ministries of National Security, Defence, Interior and the Attorney \nGeneral\u2019s Department as well as representatives of civil society \norganisations and academia.<\/p>\n\n\n\n

Counter<\/strong><\/p>\n\n\n\n

Refuting the argument that the President did not follow the right \nprocedure in setting up the Commission of Enquiry, Mr Nkrumah cited a \nSupreme Court from 2012.<\/p>\n\n\n\n

He stated that the apex court was quite clear that there were two \ntypes of constitutional instruments required for the establishment of a \ncommission of enquiry.<\/p>\n\n\n\n

\u201cThere are those that are of the nature of rules and regulations \nwhich are laid before Parliament to mature in 21 days and if you have \none that is in the nature of executive instrument, you do not require laying in Parliament for 21 days,\u201d he quote the court as saying.<\/p>\n\n\n\n

The minister, therefore, emphasised that there was the need for \nproponents of the flawed argument to make enquiries to ascertain whether\n the various commissions of enquiry established in the past were laid \nbefore Parliament for 21 days before they assumed legality.<\/p>\n\n\n\n

Commencement of work<\/strong><\/p>\n\n\n\n

He added that soon the members of the Commission of Enquiry would be \nsworn into office to begin their investigations and the Attorney-General\n would assign officers to the commission to serve a summons on \nwitnesses.<\/p>\n\n\n\n

On whether the sittings\n of the commission should be made public, Mr Nkrumah said the commission\n would make \u201ca determination of what matters they want to put out in the\n public or what items, if any, they want to hold in-camera hearings on.\u201d<\/p>\n\n\n\n

\u201cFor us, the important thing is to have an independent commission \nwith these powers that can do a decent job for everybody to see the \nantecedents, the facts and the sanctions they come with. Transparent process is what will help us as a country,\u201d he added.<\/p>\n\n\n\n

NDC\u2019s position<\/strong><\/p>\n\n\n\n

In a recent interview with an Accra-based private radio station, the \nGeneral Secretary of the opposition National Democratic Congress (NDC), \nJohnson Asiedu Nketia, said the whole idea of the Commission was flawed \nat birth because the president did not follow the right procedure in \nsetting it up.<\/p>\n\n\n\n

He was of the view that a constitutional instrument should be laid before Parliament for 21 days before a commission was established.<\/p>\n\n\n\n
