The\n University Teachers Association of Ghana (UTAG) has joined mounting \nresistance to a draft Public Universities Bill, described as an attack \non academic freedom.<\/p>\n\n\n\n

UTAG Vice President for the University of Ghana-Legon, Dr Samuel Inkumbaan, says instead of a law for all public universities across the country, the government should table specific outdated laws in each university for Parliamentary review and amendment.<\/p>\n\n\n\n

The government has cited archaic laws at some universities as justification for proposing the Public Universities Bill.<\/p>\n\n\n\n

The proposed law, being sponsored by the Ministry of Education<\/a>, spells out the procedure for the establishment of Public Universities, the principles of management of public universities and the legal status of public universities.<\/p>\n\n\n\n

The\n bill, which is expected to be sent to Parliament for consideration, \nalso seeks to provide the procedure for financing public universities \nand administration and supervision of the activities of public \nuniversities and related matters.<\/p>\n\n\n\n

Furthermore, clauses 5 and 12, the contentious aspects of the 48-clause bill, stipulate among others that the governing body of a public university<\/a> shall consist of the following nine members appointed by the President:<\/p>\n\n\n\n

(a) a chairperson nominated by the President;<\/p>\n\n\n\n

(b) the Vice-Chancellor;<\/p>\n\n\n\n

(c)  four persons nominated by the President, one of whom shall be a woman;<\/p>\n\n\n\n

(d) one representative of the registered Unions in the university on rotational basis<\/p>\n\n\n\n

(e)  one representative of the University convocation elected by the convocation;<\/p>\n\n\n\n

(h)  one representative of the students of the University, nominated by the Students\u2019 Union; and<\/p>\n\n\n\n

(j)  one representative from the National Council for Tertiary Education who shall be a non-voting member.<\/p>\n\n\n\n

It\n also states that the chairperson and other members of the Council shall\n be appointed by the President in accordance with article 70 of the \nConstitution.<\/p>\n\n\n\n

The\n President may dissolve and reconstitute the council in cases of \nemergencies or appoint an interim council to operate for a stated \nperiod, according to the draft bill.<\/p>\n\n\n\n

Dr Samuel Inkumbaan said on PM Express<\/strong>\n that every public university has been established for a particular \npurpose and hence a blanket law for all universities will be untenable.<\/p>\n\n\n\n

\u201cFor\n example, if you have a University of Ghana or a University of Science \nand Technology (KNUST), it comes with its statues; it comes with its \nlegal backing spelling out specifically what the university established \nis supposed to be doing.<\/p>\n\n\n\n

\u201cAnd\n so to say that you are generalising the act, which governs the \noperations of all the universities within the country seems to be the \ncase that you expect KNUST to operate like the University of Allied \nSciences,\u201d he said.<\/p>\n\n\n\n

He spoke on the current affairs programme on Monday evening.<\/p>\n\n\n\n

He\n added, \u201cindeed these universities are established specifically for \nspecific purposes \u2013 considering the development needs of our country.\u201d<\/p>\n\n\n\n

He said rather a common universities bill, the government should deal with specific challenges at every university.<\/p>\n\n\n\n

Public\n Relations Officer at the Education Ministry, Vincent Ekow Asafuah, had \nsaid that the law that governs KNUST, for instance, was enacted in 1961 \nand failed to deal with the violence that erupted in that institution \nlast year.<\/p>\n\n\n\n

\u201cIt [KNUST statute] is almost outmoded. It cannot be a law that in the 21st<\/sup>\n century you can use to govern a public university. That is why when the\n KNUST incident happened everybody was giving their interpretation of \nthe law. There was not a clear cut roadmap [on] dispute resolution,\u201d Mr \nAsafuah justified the proposed law.<\/p>\n\n\n\n

He\n said the inconsistencies at public universities across the country have\n been enormous, prompting the government to propose the law \u201cto bring \nuniformity as far as the universities.\u201d<\/p>\n\n\n\n

But countering this argument on PM Express,<\/strong> Dr Inkumbaan said the controversial Public Universities Bill does not satisfy the conditions as expressed by Mr Asafuah.<\/p>\n\n\n\n

\u201cThere\n are a number of regulatory bodies, including the National Council for \nTertiary Education\u201d that can deal with the inconsistencies, he said.<\/p>\n\n\n\n

In any case, he said, outdated laws can be sent to Parliament for amendment. \u201cWhy do we have Parliament,\u201d he asked.<\/p>\n\n\n\n
